  • Data collection

    1. We collect and maintain personal information that you voluntarily submit to us during your use of the Service (e.g. when registering with us, during the course of e-mail exchanges with us or as part of any customer support interactions).
      In particular, in order to sign up and create an account we request the following personal information from you:

      • name;
      • company name (if applicable);
      • e-mail address;

It won’t stop us from storing your personal information though. We’ll tell you before we lift any restriction.           You can ask us to stop processing your personal information, and we will do so, if we’re:

          • relying on our own or someone else’s legitimate interests to process your personal information except if we can demonstrate compelling legal grounds for the processing;

          You have the right not to be subject to a decision when it’s based on automatic processing, including profiling, and it produces a legal effect or similarly significantly affects you unless such profiling is necessary for entering into, or the performance of, a contract between you and us.

          If we rely on your consent (or explicit consent) as our legal basis for processing your personal information, you have the right to withdraw that consent at any time.

  • Product representation

    JOCAVI, its subsidiaries, affiliates and other related companies accept no responsibility for any web rendering issues.

    The simulations on our site do not replace a detailed system design. The simulation is based on the system and parameters supplied to us at the time of the inquiry. Actual parameters and the system design may vary from the assumed parameters and JOCAVI has not validated the system or compared the parameters utilized in the simulation to the system design or expected system values. Prior to implementation of the designated system, it is recommended that all of the parameters that have been included in the simulation be compared in detail to the implemented system. The planer, the installer or the building owner is responsible for this comparison, including all measurements, analysis of any variants or unique building or system attributes and any necessary adjustments.

    Verification and validation of the system and parameters used as a basis for this simulation are solely incumbent on the planer, the installer and the building owner.

    RAL is an international standard system partner for industry, architecture and design. It should be consulted prior to placing any order. The colours, photos and drawings shown in the website are for reference and illustration purposes only.

    The colours shown are not binding due to the differences in monitor and printing calibration. Colours may vary due to raw material suppliers' changes and some differences that may occur in tonal range.

    Typical Indoor Comfort Standards state a temperature range between 20°C and 27°C (68°F and 81°F) and a relative humidity of less than 60%. These would be considered as normal operation levels for JOCAVI product range. Sizes may vary slightly due to inherent raw material characteristics and production methods.

  • Reserved rights

    JOCAVI, its subsidiaries, affiliates and other related companies reserve the right to change the products' prices, specifications, availability and claims at any time without any prior notice.

    JOCAVI, its subsidiaries, affiliates and other related companies reserve the right to cancel or refuce orders at their sole discretion.

    JOCAVI, its subsidiaries, affiliates and other related companies reserve the right to restrict, suspend or otherwise terminate the user's access to the website as well as any other related, affiliated or subsidiary websites or electronically operated systems.

    JOCAVI, its subsidiaries, affiliates and other related companies reserve the exclusive rights to all contents and JOCAVI related trademarks available in this website.

  • Warranty

    1. Limited manufacturing warranty

      JOCAVI warrants for a period of [NUMBER] days following delivery of the Products (the “Warranty Period”) that the Products shall be free from defects in materials and workmanship.

      JOCAVI’s sole obligation under this warranty shall be to provide, at no charge to the client, replacement products.

      Defective Products must be returned to JOCAVI (at the customer’s cost) in order to receive warranty replacement (unless JOCAVI determines such return is not necessary) and shall become JOCAVI’s property.

      For a warranty claim to be made, the customer must follow the procedures established by JOCAVI from time to time.

    2. Warranty of good title

      JOCAVI agrees to indemnify the customer from any liability to any third party for infringement of United States patents, copyrights, trademarks or trade secrets with respect to JOCAVI Products sold/licensed by the client pursuant to this Agreement. This obligation does not extend to any foreign patents, copyrights, trademarks, or trade secrets or to any JOCAVI Products manufactured or modified by JOCAVI to meet the customer’s or a customer’s customer specifications. JOCAVI shall, at its option, be allowed sole and exclusive control over the defense, settlement and compromise of any claims of infringement. JOCAVI must be notified in writing by the customer within 10 days of any third party claim which, if upheld, might result in a liability subject to indemnification under this Subsection. If the distribution of the JOCAVI Products is threatened by a claim of infringement, or is likely to be enjoined or liability for infringement is found, JOCAVI may, in its discretion and at its sole option: (i) procure for the customer the right to continue distributing JOCAVI Products; or (ii) modify the JOCAVI Products so as to make them non-infringing; or (iii) substitute non-infringing products; or (iv) refund the price paid by the customer for the JOCAVI Products in its possession subject to their return by the customer and terminate this Agreement with respect to the allegedly infringing products. THIS SUBSECTION STATES THE ENTIRE LIABILITY OF SUPPLIER WITH RESPECT TO INFRINGEMENT OF ANY PATENT, COPYRIGHT, TRADEMARK, TRADE SECRET OR OTHER INTELLECTUAL PROPERTY RIGHT BY ANY SUPPLIER PRODUCT.

    3. Warranty limitation

      The warranty of JOCAVI products will cover:

      • defects in material;
      • defects in production;

      The warranty will be void when, but not limited to:

      • the product is damaged as a result of negligence;
      • the product is damaged as a result of unauthorized modification of the product;
      • the product is damaged as a result of natural disasters;
      • the product is damaged as a result of theft or loss of product;

    4. Warranty procedures

      To activate JOCAVI's warranty on your products you MUST:

      1. Contact JOCAVI by writting to info@jocaviusa.com or by post requesting the activation of warranty, with proof of purchase and photos of damage, explaining the situation which lead to the request of warranty activation within the defined limited manufacturing warranty deadlines.
      2. After positive evaluation of damage and veracity of claim, JOCAVI will request the expedition of the product (always at customers cost) a specific JOCAVI registered address along with the original packaging as well as any other documentation included in the original packaging.
      3. JOCAVI will then further inspect the product and packaging to confirm the veracity of the claim.
      4. If it is found to be at fault, JOCAVI will then take a view on whether to repair or replace the product, always saving the interest of the customer making sure he gets the best possible outcome.
      5. During this whole process, JOCAVI will maintain the customer updated, via electronic messages, of any and all steps taken to fulfull the warranty claim.

      The warranty will be void when, but not limited to:

      • the product is damaged as a result of negligence;
      • the product is damaged as a result of unauthorized modification of the product;
      • the product is damaged as a result of natural disasters;
      • the product is damaged as a result of theft or loss of product;

    5. Disclaimer

      EXCEPT AS PROVIDED IN THIS SECTION, JOCAVI MAKES NO OTHER WARRANTY, PROMISE OR OBLIGATION WITH RESPECT TO THE JOCAVI PRODUCTS, THEIR USE, REPAIR OR PERFORMANCE. JOCAVI DISCLAIMS ANY WARRANTY, PROMISE OR OBLIGATION THAT THE JOCAVI PRODUCTS SHALL BE FIT FOR ANY PARTICULAR USE OR PURPOSE, REGARDLESS OF WHETHER SUCH USE OR PURPOSE IS MADE KNOWN TO JOCAVI OR NOT. JOCAVI DISCLAIMS ANY WARRANTY, PROMISE OR OBLIGATION THAT THE JOCAVI PRODUCTS CONFORM TO ANY SAMPLES OR MODELS. JOCAVI HEREBY DISCLAIMS ALL OTHER WARRANTIES, PROMISES AND OBLIGATIONS, EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES, PROMISES AND OBLIGATIONS ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. THE WARRANTIES SET FORTH IN THIS SECTION ARE INTENDED SOLELY FOR THE BENEFIT OF THE CUSTOMER. ALL CLAIMS UNDER THIS AGREEMENT SHALL BE MADE BY THE CUSTOMER AND MAY NOT BE MADE BY JOCAVI’S CUSTOMERS.

    6. Customer warranties

      JOCAVI agrees, at its cost, to provide its customers with, at a minimum, substantially the same warranties as set forth in Subsection 17(a). The customer will assume all costs involved in providing any additional warranties.

    7. Limitation of liability

      JOCAVI SHALL IN NO EVENT BE LIABLE FOR ANY INDIRECT, SPECIAL, EXEMPLARY, INCIDENTAL OR CONSEQUENTIAL LOSS OR DAMAGE OR FOR ANY LOST PROFITS, LOST SAVINGS OR LOSS OF REVENUES SUFFERED BY THE CUSTOMER ARISING FROM OR IN ANY WAY CONNECTED WITH THIS AGREEMENT OR THE SALE, DISTRIBUTION OR USE OF JOCAVI's PRODUCTS. THE CUSTOMER SHALL INDEMNIFY JOCAVI AND HOLD IT HARMLESS FROM ANY CLAIMS, DEMANDS, LIABILITIES, SUIT OR EXPENSES OF ANY KIND ARISING OUT OF THE SALE, SUBLICENSE OR USE OF JOCAVI PRODUCTS IN THE TERRITORY OR BY CUSTOMER’S CUSTOMERS. THIS SECTION SHALL SURVIVE THE TERMINATION OF THIS AGREEMENT FOR ANY REASON.

      YOU ACKNOWLEDGE AND EXPRESSLY AGREE THAT USE OF OUR SITE AND ANY ASSOCIATED DOMAINS (THE "SITE") IS AT YOUR OWN RISK. JOCAVI USA CORPORATION, ITS AFFILIATES AND SUBSIDIARIES, AND EACH OF THEIR DIRECTORS, OFFICERS, AGENTS AND EMPLOYEES THEREOF (COLLECTIVELY, THE "COMPANY"), CANNOT AND DOES NOT VERIFY OR WARRANT THE ACCURACY OR COMPLETENESS OF THE INFORMATION CONTAINED ON THE SITE. NEITHER THE COMPANY NOR ANY OF ITS CONTENT PROVIDERS OR LICENSORS, MAKES ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, OF ANY KIND REGARDING THE SITE, THE CONTENT, ANY PRODUCTS OR SERVICES, ANY ADVERTISING MATERIAL OR THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SITE OR ANY PRODUCT OR SERVICE FEATURED ON THE SITE.   • Return and refund policy

    From time to time, the customer might have the need to return products to JOCAVI and ask for refunds.

    To return a product to JOCAVI, the customer must ask for a refund up to 7 days after delivery of product.

    In order for JOCAVI to process the refund correctly, the product must be returned in its original packaging, unused and undamaged, and along with the receipt or proof of purchase.

    JOCAVI reserves the right to refuse a refund if any of the above conditions aren't met.

    In the case of product return, all shipping costs must be met by the customer.

    Items on sale are not eligible for refunds.

    Customers can choose whether to get a refund or exchange the existing product for a new one.

    Customers must always have written confirmation from JOCAVI directly before shipping any products for refund.

    IF YOU DO NOT AGREE TO THE TERMS STATED ABOVE OR TO ANY CHANGES THE COMPANY MAKES IN THESE TERMS, PLEASE EXIT AND CEASE ALL USE OF THE SITE IMMEDIATELY.
